
Terms and Conditions
This page encloses the generic terms and conditions associated with the purchase of a freelance commission from Devon Collins. Aspects of the following agreement may be negotiated on a case-by-case basis. If you are considering any alterations to this agreement, you must inform Devon as early in communication as possible. Any alterations to these terms and conditions, price, deadlines, and/or any other requests will be worked out and then signed during the Agreement phase of the commission process before work on the commission begins.
General

The following constitutes a legal agreement between you (The Client) and Devon Collins (The Artist)

Prices are subject to change based on demand.

Devon Collins reserves the right to accept or reject any commission request for any reason.
Payment
-
US Dollars are the only currency accepted. (If you are from outside of the US, PayPal is an easy way to convert currency.)

Payment will be split into a Deposit and a Final Payment. The Deposit must be paid before work on the commission is begun. The Final Payment must be paid before the completed artwork is delivered.

Do NOT send money until a price has been agreed upon and an Invoice sent.

The Artist will NEVER call to request a wire transfer or bank information. Payments will ONLY be requested through this website and via subsequent means of communication.
Process & Delivery

The time it takes to finish commissions varies from 1 week to 3 months based on complexity, workload, and the wildcard of life. If you have a desired deadline (such as a birthday or event) please let The Artist know when ordering the piece in order to establish an acceptable timeline.

Once the commission is completed and the Final Payment processed, you will receive a full resolution file and a web-friendly size.

Additional fees will occur for physical print requests. The Artists will take the utmost care in packing but is ultimately not responsible for the condition of the artwork after shipping.

At this time shipping is available in the United States only.
Alterations
-
Price includes up to 2 review sessions. (Devon will send you thumbnails and/or rough sketches and you may give suggestions to ensure the commission is going in the direction you want.)

An additional fee may be charged for alterations on the final piece.

If your references are unclear to start with, alterations will come at an extra charge. Every attempt will be made to ensure The Artist has adequate reference(s) before starting a commission.
Copyright &
Usage
The Artist, Devon Collins:

reserves the right to cancel and refund the order at any time for any reason.

retains all copyrights over the commissioned artwork.
-
will NOT claim the intellectual property (IP) of the commissioned artwork.

will NOT further sell the commissioned artwork unless you (The Client) permit such use OR break any of the terms.

reserves the right to post the commissioned artwork online, in their portfolio as well as in publications such as art books.
You, The Client:
-
MAY upload the commissioned artwork on any website and social channels, only with proper credit to The Artist.

may NOT make profits from the commissioned piece (reselling, redistributing, etc.)

may NOT alter the commissioned artwork without The Artist's consent.

retain the rights to the intellectual property (IP) of the artwork.

may NOT use the commissioned artwork for commercial purposes.

may NOT claim the artwork as your own.
Any violations of these permissions will be considered copyright infringement and will void your rights as listed above and allow me to utilize the artwork in any way I see fit, including for further profit or commercial use.
Refunds & Cancellation

The Client is not allowed to cancel and request a refund once work on the commission has started.

If, for any reason, The Artist is unable to start a commission, The Client will receive a full refund.

If The Client cancels their order before it has been started, they may receive a full refund. A portion of the Deposit may be withheld if materials have been purchased for the commission.

If The Client is entitled to a refund, they may NOT request a PayPal chargeback. Devon will transfer the money back to The Client directly.

If a PayPal chargeback is requested, all aforementioned rights to the commissioned piece will be forfeited. The Artist will decline the chargeback and supply PayPal with evidence of this agreement. Furthermore, you will be blacklisted from commissioning Devon Collins again.
